These Terms of Use (“Terms”) govern your access to and use of the Viserato website, apps and related services (the “Platform”) operated by Viserato DOO, Sveta Vraca, 85331 Kotor, Montenegro (“Viserato”, “we”, “us”). By creating an account or using the Platform, you agree to these Terms.

1. Who we are

Viserato is an online marketplace that connects travellers (“Guests”) with independent service providers (“Hosts”) offering stays, tours, yachts, cars, transfers, restaurants and related tourism services in Montenegro and the wider Adriatic region.

Unless we expressly say otherwise, Viserato is not the owner, operator or provider of the underlying travel or hospitality services. Hosts are responsible for the services they offer. Company registration and tax numbers will be published on this page when available.

2. Eligibility and accounts

Unless otherwise indicated on the Platform, you must be at least 18 years old to use the Platform and to create or manage an account.

  • You must provide accurate registration information and keep it up to date.
  • You are responsible for activity under your account and for keeping login credentials secure.
  • You may not transfer your account without our written consent.
  • We may suspend or close accounts that breach these Terms, applicable law, or Host/Guest policies.

3. Our role as a marketplace

The Platform enables discovery, messaging, booking and payment facilitation between Guests and Hosts. A booking creates a contract between the Guest and the Host for the listed service, subject to the listing details, House Rules and the Host’s cancellation and other policies shown during booking.

Viserato may collect payment from Guests and pay Hosts after deducting applicable platform fees/commission. Commission rates may vary by service type, commercial agreement or promotion and will be shown to Hosts in their host tools or agreement.

Viserato does not act as an insurer, travel agent of record for the underlying service (unless separately stated), or guarantor of Host performance. Any travel, liability or other insurance is your responsibility unless a Host expressly includes it in the listing.

4. Bookings and payments

  • Prices, fees, taxes (where displayed), deposits and extras shown at checkout form part of your booking request.
  • Payments are processed via our payment partners (including AllSecure or successors). Pre-authorisation, 3-D Secure and other fraud checks may apply.
  • A booking is confirmed only when we notify you that it is confirmed (or as otherwise stated in the flow).
  • You authorise us to charge the payment method you provide for the booking total and any amounts you agree to later (for example damage claims handled under Host policies, where permitted).
  • Currency, FX and card issuer fees may apply and are outside our control.

5. Cancellations, changes and refunds

Each Host sets the cancellation and refund policy for their listing (for example flexible, moderate, strict or non-refundable). The policy displayed at the time of booking controls, together with any mandatory consumer rights that cannot be waived under applicable law.

  • Guest-initiated cancellations are handled according to the Host policy and Platform tools.
  • Host cancellations or material listing failures may lead to a refund and/or other remedies we reasonably decide.
  • Force majeure, illegal listings, fraud or safety issues may result in cancellation and refund decisions by Viserato.
  • Refund timing depends on payment partners and banks.

6. Guest conduct

  • Comply with Host House Rules, local laws and safety instructions.
  • Do not misuse messaging, reviews, payments or identities.
  • Do not book if you cannot meet age, licence, capacity or other requirements stated for the service (for example car rental driver age).
  • Treat Hosts, staff and other travellers respectfully; harassment and discrimination are prohibited.

7. Content, reviews and intellectual property

You retain ownership of content you submit (reviews, messages, photos, listing text if you are a Host). You grant Viserato a worldwide, non-exclusive, royalty-free licence to host, use, reproduce, modify for format, translate, distribute and display that content in connection with operating and promoting the Platform.

Do not post illegal, infringing, deceptive, harmful or off-platform contact-harvesting content. We may remove or restrict content and accounts under our moderation practices (see our Digital Services Act notice).

Viserato brands, software and Platform materials are owned by us or our licensors. You may not copy or exploit them except as allowed by these Terms.

8. Disclaimers and limitation of liability

The Platform is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim warranties regarding uninterrupted availability, fitness for a particular purpose, and the quality or safety of Host services.

To the fullest extent permitted by law, Viserato is not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or goodwill arising from Host services, Guest/Host disputes, or Platform use.

Nothing in these Terms excludes liability that cannot be limited under Montenegro law (including for fraud or wilful misconduct).

9. Indemnity

You agree to indemnify and hold harmless Viserato and its directors, employees and partners from claims arising out of your breach of these Terms, your misuse of the Platform, or your booking/service (except to the extent caused by our wilful misconduct).

10. Changes, suspension and termination

We may update these Terms. Material changes will be posted on the Platform with an updated “Last updated” date. Continued use after changes means you accept the revised Terms, except where mandatory law requires additional consent.

We may modify, suspend or discontinue parts of the Platform. You may stop using the Platform at any time. Provisions that by nature should survive (including liability, indemnity, IP and governing law) will survive termination.

11. Governing law and disputes

These Terms are governed by the laws of Montenegro. Courts in Kotor, Montenegro have jurisdiction, without prejudice to mandatory consumer protections that may give you rights to sue in your country of residence where applicable.
